Agis's giant inflatable artwork broke free from its moorings at a festival in Durham in 2006, killing two women and injuring 27 people.
The 77-year-old who lived in Kirton Gardens, Bethnal Green, was convicted at Newcastle Crown Court earlier this year for breaching the Health and Safety at Work Act and was fined �10,000.
But a jury failed to reach a verdict on manslaughter charges and the Crown Prosecution Service announced there would be no retrial.
