Agis's giant inflatable artwork broke free from its moorings at a festival in Durham in 2006, killing two women and injuring 27 people.
The 77-year-old who lived in Kirton Gardens, Bethnal Green, was convicted at Newcastle Crown Court earlier this year for breaching the Health and Safety at Work Act and was fined 10,000.
But a jury failed to reach a verdict on manslaughter charges and the Crown Prosecution Service announced there would be no retrial.
